Terms of Service

1. Acceptance of Terms

By accessing and using Segment Club at www.segmentclub.com ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable Australian laws and regulations. If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, registered members, and contributors. By creating an account, you confirm that you have read and understood both these Terms and our Privacy Policy.

2. Description of Service

Segment Club is an Australian cycling community platform. The Service includes:

  • Integration with Strava for cycling activity tracking and performance analytics
  • A points system that rewards members for riding, engagement, referrals, and community participation
  • A rewards programme where members can redeem points for vouchers and offers from partner businesses
  • A referral programme allowing members to invite others and earn points
  • Community features including cycling events, news, and partner listings
  • Bike management and service tracking tools
  • Bug reporting and feature suggestion functionality

3. Account Registration

3.1 Eligibility

You must be at least 18 years old to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement.

3.2 Account Creation

You may register using email and password, Google OAuth, or Strava OAuth. Regardless of the sign-up method, you agree to provide accurate, current, and complete information during registration and onboarding, and to update such information to keep it accurate.

3.3 Account Security

You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account via our Contact Us page.

3.4 One Account Per Person

Each person may only maintain one account. Creating multiple accounts to exploit the points or referral systems is a violation of these Terms and may result in account termination.

4. Privacy and Data Collection

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms.

By using the Service, you acknowledge and agree to the collection and processing of personal information as described in the Privacy Policy, including:

  • Account and profile information (name, email, phone, location, cycling preferences)
  • Strava activity data (routes, distance, speed, elevation, GPS coordinates, heart rate, power)
  • Usage data collected through Google Analytics and Microsoft Clarity
  • Cookies for authentication, referral tracking, and analytics

We comply with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and the Spam Act 2003.

5. Marketing Communications and Consent

By creating an account and consenting during the sign-up process, you agree to the collection, use, and disclosure of your personal information as described in our Privacy Policy, including for direct marketing purposes in accordance with the Privacy Act 1988 and Spam Act 2003.

We may send you marketing and promotional communications via email about products, services, partner offers, events, and news. You can opt out of marketing communications at any time by:

  • Clicking the unsubscribe link in any marketing email
  • Contacting us via our Contact Us page

We will action your opt-out request within 5 working days at no cost. Opting out of marketing does not affect transactional emails (e.g., account verification, password resets, voucher codes).

6. Points System

6.1 Earning Points

Members earn points through eligible activities including cycling (tracked via Strava), signing up, connecting Strava, linking social profiles, sharing articles, viewing events, submitting feature suggestions, reporting confirmed bugs, weekly logins, and successful referrals. Point values are set by Segment Club and may be adjusted at any time.

6.2 Points Have No Cash Value

Points are not currency and have no monetary value. They cannot be exchanged for cash, transferred to other members, or sold. Points are earned for engagement and can only be redeemed for rewards within the Service.

6.3 Points Expiry and Forfeiture

Points do not expire while your account is active. If your account is terminated (by you or by us), any accumulated points will be forfeited.

6.4 Abuse and Fraud

We reserve the right to void points, reverse transactions, or suspend accounts if we detect abuse of the points system, including but not limited to: creating fake activities, using multiple accounts, gaming referral codes, or any other fraudulent behaviour.

7. Rewards and Redemption

7.1 Redeeming Points

Members can redeem points for vouchers and offers from Segment Club's partner businesses. Points are deducted immediately upon redemption. Redemptions are final and cannot be reversed once a voucher code has been generated.

7.2 Voucher Codes

Each redemption generates a unique voucher code. Voucher codes are for single use only and are subject to the terms and conditions of the issuing partner. Segment Club is not responsible for a partner's refusal to honour a voucher or for changes to partner offers.

7.3 Reward Availability

Rewards are subject to availability and may have stock limits. We reserve the right to modify, suspend, or discontinue rewards at any time without notice.

7.4 Partner Responsibility

Segment Club facilitates the reward programme but does not manufacture, supply, or guarantee the goods or services offered by our partners. Any issues with redeemed rewards should be raised with the relevant partner directly, or with us via our Contact Us page.

8. Referral Programme

Members receive a unique referral code and link that can be shared with others. When a referred person creates an account and completes the full onboarding process (all three steps), the referring member earns referral points.

  • Referral points are awarded only upon the referee's successful completion of onboarding
  • Self-referrals are not permitted
  • Referral codes are tracked via a browser cookie with a 30-day time-to-live
  • We reserve the right to modify referral point values or programme terms at any time
  • Abuse of the referral system (e.g., fake accounts, automated sign-ups) will result in point forfeiture and possible account termination

9. Bug Reporting

Members can report bugs through the Bug Report tab in My Garage. Points are awarded for confirmed bugs (as determined by our team), subject to a monthly cap. Submitting a bug report does not guarantee it will be confirmed or that points will be awarded.

Bug reports may include screenshots uploaded to our servers. By submitting a bug report, you grant us the right to use the information provided to investigate and fix the reported issue.

10. Third-Party Integrations

10.1 Strava

When you connect your Strava account, you authorise us to access your cycling activity data via Strava's API. You remain subject to Strava's own Terms of Service and Privacy Policy. You can disconnect Strava at any time from your account settings.

10.2 Google and Microsoft Services

We use Google Analytics and Microsoft Clarity for website analytics and user experience improvement, as described in our Privacy Policy.

10.3 Limitation of Liability for Third Parties

We are not responsible for the practices, policies, availability, or content of third-party services. Your use of third-party services is governed by their respective terms and is at your own risk.

11. User Conduct

You agree not to:

  • Provide false, misleading, or inaccurate information
  • Impersonate any person or entity
  • Create multiple accounts or use automated tools to interact with the Service
  • Engage in unlawful, harmful, threatening, abusive, harassing, defamatory, or objectionable behaviour
  • Interfere with or disrupt the Service, servers, or networks
  • Attempt to gain unauthorised access to any portion of the Service
  • Scrape, data mine, or harvest data from the Service without our express written consent
  • Upload malicious code, viruses, or any other harmful technology
  • Use the points system, referral programme, or bug reporting feature in a fraudulent manner

12. Intellectual Property

12.1 Our Property

The Service and its original content, features, functionality, branding, and design are owned by Segment Club and are protected by Australian and international copyright, trademark, and intellectual property laws.

12.2 User Content

You retain ownership of content you submit (e.g., bug reports, feature suggestions, profile information). However, you grant us a non-exclusive, royalty-free licence to use, store, and display such content for the purpose of operating and improving the Service.

13. Limitation of Liability

To the maximum extent permitted by Australian law (including the Australian Consumer Law), Segment Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, or goodwill resulting from:

  • Your use or inability to use the Service
  • Unauthorised access to your account or personal information
  • Interruption, suspension, or cessation of the Service
  • Errors, inaccuracies, or omissions in any content
  • Issues with reward redemptions or partner offers
  • Loss of points due to account termination or system changes

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

14. Disclaimer

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by Australian law, Segment Club disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

15. Termination

We may suspend or terminate your account and access to the Service at our discretion, including for breach of these Terms, abuse of the points system, or fraudulent activity.

You may request account deletion at any time by contacting us via our Contact Us page. Upon deletion:

  • Your account and personal information will be deleted in accordance with our Privacy Policy
  • Any accumulated points will be forfeited
  • Active voucher codes already issued will remain valid until their expiry
  • Certain data may be retained as required by law (see our Privacy Policy, Section 10)

16. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

17. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice by posting the updated Terms on this page and, where possible, sending an email notification. By continuing to use the Service after changes take effect, you agree to the revised Terms.
