By accessing and using Segment Club ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, customers, merchants, and contributors of content.

2. Description of Service

Segment Club is a cycling community platform that connects cyclists, tracks performance, facilitates segment competitions, and provides community features. The Service includes:

• Integration with Strava and other third-party fitness tracking services
• Performance tracking and analytics
• Community features including group rides and events
• Segment leaderboards and competitions
• User profiles and social networking features

3. User Accounts and Registration

3.1 Account Creation

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Eligibility

You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age.

4.1 Data We Collect

• Cycling activity data from connected services (Strava)
• Performance metrics and riding patterns

You grant Segment Club a worldwide, non-exclusive, royalty-free license to use, store, display, and analyze your data for the purposes of:

• Providing and improving the Service
• Creating aggregated and anonymized data insights

• Commercial partnerships with third parties (in aggregated form)

5. Australian Privacy Compliance

As an Australian-based service, we comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Your personal information is collected, stored, and processed in accordance with Australian privacy law.

5.1 Cross-Border Data Disclosure

We may disclose your personal information to overseas recipients, including cloud service providers and business partners. By using the Service, you consent to such disclosures in accordance with APP 8.

6.1 Strava Integration

When you connect your Strava account, you authorize us to access your Strava data in accordance with Strava's API Terms of Service. You remain subject to Strava's terms and privacy policy.

6.2 Third-Party Liability

We are not responsible for the practices, policies, or content of third-party services you connect to Segment Club. Your use of third-party services is at your own risk.

7. User Conduct

You agree not to:

• Upload false, misleading, or inaccurate information
• Impersonate any person or entity
• Engage in any unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable behavior
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service for any commercial purpose without our express written consent
• Scrape, data mine, or harvest data from the Service

8. Intellectual Property

8.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by Segment Club and are protected by international copyright, trademark, and other intellectual property laws.

8.2 User Content

You retain ownership of content you submit to the Service, but grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the Service.

9. Limitation of Liability

To the maximum extent permitted by Australian law, Segment Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred from using content

10. Warranty Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY AUSTRALIAN LAW, SEGMENT CLUB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
